The present terms and conditions of use (the “terms”) define the respective undertaking of the seller (“Montres Omax S.A.”, “we”, “our”or “us”) and the buyer (“you” or “your”) for any merchandise sold/purchased on the “Omaxwatches.ch” website (“the site”). Please read them carefully as they represent the entire agreement between you and us and will apply to your purchase. By placing an order on the site, you unconditionally accept these terms.

The terms remain in force as far as they appear on the site. Montres Omax S.A. reserves the right to amend them partly or wholly at any time. The actual version governing relations between you and us is the one existing on the site at time of your ordering. It is your responsibility to check the terms each time you intend to make a purchase on the site.

INTERNET

We assume no liability for any viruses or disabling features which could occur in relation with the use of Internet which is your sole responsibility. In spite of all precautions taken, transmission of personal information via Internet may not be totally safe and reliable. You are aware that you give us information at your own risk.

OFFER

The goods presented on the “Omaxwatches.ch” site are all offered for sale, subject to availability, ex warehouse Geneva, Switzerland, for delivery worldwide, as far as their importation is authorized in the country of destination.

Our offers are reserved to private persons having reached the age of 18 years and bearers of a credit card valid at least one month after the date of your order. Purchase must be made for your own use or to make a gift. Any purchase in view of resale is prohibited.

Each product offered on the site is presented with a photography, its references and price. While the greatest care is brought to the presentation of our site, it may contain some errors or technical variation. Descriptions, photographs and prices are given for information only and do not involve our liability. We reserve the right to modify them at any time as long as we have not confirmed your order. We may refuse the sale of a product if it is out of stock or if it is misrepresented or wrongly priced.

APPLICABLE LAW

Relations between you and us are governed by Swiss Laws and within the competence of the Courts of the Canton of Geneva.

The waiver of a breach of any stipulation of the terms does not prevent the subsequent enforcement of that stipulation and will not be deemed a waiver of any subsequent breach. If any part of the terms is, for any reason, declared invalid, the other parts will remain in force and effect.

DELIVERY

Delivery will be made by FeDex. Our contract with you ends once the courier service collects the products from us. We are not responsible for any loss or damage to the products once they have left our warehouses.

You should receive your purchase within a period of 15 days (average time is 7 days). We would inform you if there is an additional delay. If delivery exceeds four weeks beyond the estimated delivery date mentioned on our order confirmation, you may cancel or amend your order and ask any refund of money which could be due to you. If your order is maintained, we will inform you by email of the date and references of your shipment. To track your order, enter its reference number on the “track” section of the site of FedEx.com.
